1. Introduction
Welcome to AICallAgent (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our AI-powered call answering services (“Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please refrain from using our Services.
2. Services Provided
AICallAgent provides AI-driven phone support solutions, including virtual receptionist services, inbound and outbound voice AI, appointment bookings, and seamless tool integration. Our Services are designed to enhance business communication with 24/7 availability.
3. User Responsibilities
By using our Services, you agree to:
- Provide accurate and up-to-date information during the registration and setup process.
- Use the Services in compliance with applicable laws, including data protection laws such as the UK GDPR and the Data Protection Act 2018.
- Not engage in any activity that may disrupt or interfere with the proper functioning of the Services.
- Maintain the confidentiality of any account credentials and promptly notify us of any unauthorized access or security breaches.
4. Pricing and Payment
Our pricing plans are as follows:
- Standard Plan: £49/month, including 150 minutes of call answering. Additional minutes are charged at £0.30 per minute.
- One-Time Setup Fee: £149.
- Additional services and integrations may incur extra charges as specified on our website.
Payments are due monthly in advance and are non-refundable. We reserve the right to modify pricing with prior notice.
5. Volume Discounts
We offer volume discounts based on monthly usage:
- 1,000+ minutes/month: 10% off (£0.27 per additional minute).
- 2,000+ minutes/month: 15% off (£0.255 per additional minute).
- 3,000+ minutes/month: 25% off (£0.225 per additional minute).
Note: The monthly plan allocation of 150min is excluded from these calculations
6. Service Activation and Setup
Upon successful registration and payment of the setup fee, we will initiate the setup process for your AI Voice Agent. The standard setup period is within 48 hours. You are responsible for providing necessary information. If additional services are purchased including integration with your existing tools and calendars timelines can change depending on the complexity of the tools.
7. Data Protection and Privacy
- Data Access for Onboarding: To facilitate the onboarding process and provide services, we require access to specific customer data. This may include, but is not limited to, customer names, contact details, and relevant business information.
- Subprocessors: We use trusted third-party subprocessors, including but not limited to Zapier and Twilio, for the purposes of call handling, data transmission, and platform integrations. These subprocessors may access or process your data in transit, but only as necessary to carry out the onboarding process and service delivery.
- Data Security: We employ industry-standard security measures to protect your data, including encryption during transmission and secure storage solutions. Your data will not be sold to or shared with third parties except as required to deliver the service.
8. Consumer Rights and Cancellation
- Right to Cancel: If you are a consumer, you have the right to cancel the service within 14 days of purchase under the Consumer Contracts Regulations 2013.
- Subscription Termination: Either party may terminate the service with 30 days’ written notice. Any outstanding charges for additional minutes or services will be billed accordingly.
- Cancellation of Onboarding: If onboarding is cancelled after the process has started but before completion, you may be liable for partial fees depending on the progress made.
9. Limitation of Liability
To the fullest extent permitted by law:
- AICallAgent shall not be liable for indirect, incidental, or consequential damages.
- Our total liability shall not exceed the amount paid by you for the Services in the preceding three months.
- Any claims must be brought within six months from the date of the incident giving rise to the claim.
10. Modifications to Terms
We may update these Terms from time to time. Changes will be posted on our website, and continued use of the Services constitutes acceptance of the revised Terms.
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
